Terms & Conditions

The agreement between you and Trasely, including the End User License Agreement for the app.

These Terms & Conditions (the “Terms”) form a binding agreement between you and Renat Tlebaldiev, trading as Trasely (“Trasely”, “we”, “us”), covering the Trasely app for iPhone and iPad, the website at trasely.app, and any related services (together, the “Service”). They also serve as the End User License Agreement (“EULA”) for the app.

By downloading, installing or using Trasely, you agree to these Terms. If you do not agree, do not use the Service. Please read section 4 carefully — it matters more than the rest.

1. Who you are contracting with

This agreement is between you and us only. It is not with Apple. See section 16 for the terms that apply specifically because Trasely is distributed through the App Store.

2. Eligibility

You must be at least 13 years old to use Trasely. If you are under 18, or under the digital-consent age that applies where you live (which may be up to 16 in the European Economic Area and the United Kingdom), you may use Trasely only with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of the Service.

You confirm that you are legally permitted to use the Service where you are.

3. Licence to use the app

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Trasely on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Where Family Sharing or volume purchasing applies, other accounts associated with the purchaser may also use the app in accordance with those Usage Rules.

You may not, except to the extent that applicable law expressly permits it despite this restriction:

4. Safety — please read this

In particular, you agree that you will:

Physical activity carries risk. Consult a qualified medical professional before beginning or significantly changing an exercise routine, particularly if you have a health condition. Trasely provides no medical or fitness advice and is not a medical device.

Distances, elevation figures and estimated durations are approximations derived from map data and may differ from what you actually cover.

5. Your content

Photos you select, shapes you draw and routes you create remain yours. Trasely processes them on your device and stores them on your device; we do not receive them, do not host them, and therefore ask for no licence in them. Nothing in these Terms gives us any right to use, publish or sell your content.

You are responsible for what you feed into the app. You confirm that you have the rights necessary to use any photo you import, and that using it does not infringe anyone’s copyright, trademark, privacy or publicity rights. You must not use Trasely to create routes intended to depict unlawful content, to harass or target an individual, or to require entry into places you may not lawfully enter.

If you export a route and upload it to Strava, Garmin Connect, Komoot or any other platform, that upload is governed by the terms and privacy policy of that platform, not by these Terms.

6. Free tier and Trasely PRO

Trasely is free to download. The free tier includes a curated subset of the shape library and a distance cap. Trasely PRO is an optional paid upgrade that removes those limits and unlocks the full feature set described in the app.

The exact price, currency, billing period and any introductory offer or free trial are displayed in the app before you confirm, and are set by us for your App Store storefront. Prices differ by country and may change; a change never affects a billing period you have already paid for.

6.1 Auto-renewable subscriptions

6.2 Lifetime purchase

Lifetime is a one-time purchase that grants access to the PRO features offered in Trasely for as long as we continue to operate the app on the App Store. It is not a perpetual guarantee that the app, any specific feature, or any third-party service it depends on will remain available indefinitely. It does not renew and cannot be cancelled, and it can be restored on your devices via Settings → Subscription → Restore Purchases using the same Apple Account.

6.3 Changes to features and plans

We may add, change or withdraw features. If we materially reduce what PRO includes, or change the price of an ongoing subscription, we will give you notice through the app or the App Store before it takes effect, and you may cancel before the change applies. We will not remove a feature that is the substantial reason a Lifetime purchase was made without offering a reasonable remedy.

7. Refunds and cancellation rights

All purchases are processed by Apple, and refunds are handled by Apple under the Apple Media Services Terms and Conditions. We cannot issue refunds ourselves. To request one, use reportaproblem.apple.com or your Apple Account purchase history.

If you are a consumer in the European Union, the United Kingdom or another jurisdiction with a statutory right of withdrawal, that right applies to your purchase as set out in Apple’s terms; note that it may be lost once digital content has been supplied with your express consent and acknowledgement. Nothing here limits any non-waivable statutory right you have, including rights in respect of digital content that is not as described or not of satisfactory quality.

If Apple declines a refund and you believe the outcome is wrong, contact us and we will help where we reasonably can.

8. Third-party data, services and trademarks

Trasely depends on services and data we do not control. Their availability, accuracy and coverage are their responsibility, not ours, and their terms apply to your use of them alongside these Terms.

You must comply with any applicable third-party terms of agreement when using Trasely — for example your mobile data plan, and the terms of any platform you export routes to.

9. Intellectual property

We own all rights in the Trasely app, its source code, design, user interface, the built-in shape library, the Trasely name and logo, and all related branding. These Terms grant you a licence to use the app; they transfer no ownership and give you no right to use our name, logo or branding.

Routes you generate are yours to use, including commercially. The underlying map data remains subject to the OpenStreetMap licence referred to in section 8.

10. Availability and changes to the Service

We aim to keep Trasely working, but we do not guarantee that it will be available without interruption or error. We may suspend the Service for maintenance, or modify or discontinue it, and we will give reasonable notice where we can. If we discontinue the Service entirely, we will give notice in the app and through the App Store listing, and will provide a reasonable remedy for any unexpired paid period.

Some features require an internet connection and a supported iOS version. It is your responsibility to have a compatible device and any data connection you need, including any charges from your carrier.

11. Disclaimer of warranties

To the fullest extent permitted by law, and without limiting your statutory rights as a consumer, the Service is provided “as is” and “as available”. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not warrant that generated routes will be safe, passable, legal to follow, of a particular length, aesthetically satisfying, or recognisable as any particular shape. Route quality depends heavily on the street network at the location you choose, and some locations cannot support some shapes at all.

Nothing in this section affects mandatory consumer guarantees where you live.

12. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Subject to that, and to the fullest extent permitted by law:

If you are a consumer, we are liable only for loss that is a foreseeable result of our breach, and this section does not affect your statutory rights.

13. Indemnity

To the fullest extent permitted by law, you agree to indemnify us against claims, liabilities, damages and reasonable legal costs arising from your breach of these Terms, your infringement of a third party’s rights, or your unlawful use of the Service. This does not apply to claims arising from our own negligence or breach, and it is limited to the extent permitted where you are a consumer.

14. Suspension and termination

You may stop using Trasely at any time by deleting it. Deleting the app does not cancel an active subscription (see section 6.1).

If you materially breach these Terms, we will notify you and, where the breach can be put right, give you 14 days from that notice to do so before suspending or terminating your access. We may suspend or terminate immediately, without prior notice, where you break the law, infringe intellectual property rights, attack or abuse our infrastructure, or create a risk of harm to others.

On termination your licence ends and you must stop using the app and delete your copies. Sections 5, 8, 9, 11, 12, 13, 15 and 16 survive termination. Where we terminate without cause, or where termination is our fault, we will refund or arrange the refund of any unexpired paid period.

15. Governing law, disputes and consumer rights

These Terms are governed by the laws of Poland, excluding its conflict-of-laws rules. Disputes may be brought before the competent courts of that country.

If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside, and you may also bring proceedings in the courts of that country.

We are not obliged, and do not currently undertake, to participate in dispute resolution proceedings before a consumer arbitration board. Before starting formal proceedings, please contact us at trasely.app@gmail.com — most issues can be resolved directly.

16. App Store terms

These provisions apply because Trasely is distributed through the Apple App Store, and Apple requires them.

  1. Acknowledgement. This EULA is concluded between you and us only, and not with Apple. We, not Apple, are solely responsible for Trasely and its content. This EULA does not provide usage rules for Trasely that conflict with the Apple Media Services Terms and Conditions.
  2. Scope of licence. The licence granted to you is a non-transferable licence to use Trasely on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Trasely may also be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
  3. Maintenance and support. We are solely responsible for providing any maintenance and support for Trasely. Apple has no obligation whatsoever to furnish any maintenance or support services for it.
  4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Trasely fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Trasely to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Trasely, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
  5. Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to Trasely or your possession and use of it, including (i) product liability claims; (ii) any claim that Trasely fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation. This EULA does not limit our liability to you beyond what is permitted by applicable law.
  6. Intellectual property rights. If a third party claims that Trasely or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer name and address. Questions, complaints or claims relating to Trasely should be directed to Renat Tlebaldiev, trasely.app@gmail.com
  9. Third-party terms. You must comply with applicable third-party terms of agreement when using Trasely — for example, you must not be in violation of your wireless data service agreement when using it.
  10. Third-party beneficiary. You and we acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that upon your acceptance of its terms and conditions, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

17. General

Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed, and the remaining provisions stay in full force.

No waiver. If we do not enforce a right, that is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them to a successor in connection with a transfer of the Trasely business, on notice to you, provided your rights are not reduced.

Entire agreement. These Terms together with the Privacy Policy are the entire agreement between you and us about the Service, and replace any earlier version.

Changes. We may update these Terms. The version number and effective date above always reflect the current text. For material changes we will give notice in the app or on this page at least 14 days before they take effect, and continued use after that date means you accept them; if you do not, stop using the Service and, where a paid period is affected, contact us. Previous versions are available on request.

Language. These Terms are drawn up in English. Any translation is provided for convenience; in the event of conflict the English text prevails, except where mandatory local law provides otherwise.
